South Dakota Circuit Judge Jon Sogn has denied Rhines request to delay his execution next week over the drug to be used. Rhines had argued that pentobarbital does not act quickly enough to comply with state law. But state prison officials were still awaiting word from the U. A third juror said there had been lots of discussion of homosexuality during deliberations and a lot of disgust. Rhines last week unsuccessfully challenged the drug the state used in the execution at the state prison in Sioux Falls. The state Supreme Court rejected Rhines appeal of that ruling on Monday and his attorneys promptly appealed to the U.
